Terms of Service

By using this website or engaging D&D Commercial Services for services, you agree to these terms. Services are provided subject to a written service agreement signed by both parties. All work is performed in accordance with Ontario Building Code and applicable regulations.

Service Estimates

All estimates are provided in writing. Estimates are valid for 30 days from the date of issue. Final pricing may be adjusted if site conditions differ materially from those assessed during the estimate visit.

Services Provided

D&D Commercial Services provides commercial property maintenance services including bollard installation, drainage and trough systems, commercial window and door installation, line painting, parking lot maintenance, commercial pressure washing, and property assessments. Services are subject to availability and written agreement.

Payment & Cancellation

Payment is due upon completion of services unless otherwise agreed in writing. We accept major credit cards, e-transfer, and cash. For ongoing service contracts, payment terms are outlined in the individual service agreement. We require at least 24 hours notice for cancellations or rescheduling.

Liability Disclaimer

D&D Commercial Services carries appropriate liability insurance. We are not responsible for:

• Pre-existing damage to property surfaces, parking lots, windows, or doors
• Damage caused by undisclosed site conditions or aging materials
• Indirect or consequential losses arising from our services
• Damage resulting from the client's failure to follow post-service care instructions

Damage claims must be reported in writing within 48 hours of service completion. Our liability is limited to the value of the service provided.

Limitation of Liability

To the fullest extent permitted by applicable law, D&D Commercial Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of our website or services. Our total liability for any claim shall not exceed the value of the specific service giving rise to that claim.

Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. D&D Commercial Services is a D&D Property Management sister company operating in Kitchener-Waterloo, Ontario.

Dispute Resolution

We encourage informal resolution first. If a dispute cannot be resolved within 30 days through direct contact, the parties agree to attempt mediation before formal legal proceedings. Unresolved disputes shall be subject to the exclusive jurisdiction of Ontario courts.

• Step 3: If unresolved, voluntary mediation or Ontario court proceedings

Ongoing Maintenance Contracts

For clients with ongoing maintenance agreements, services are delivered per the schedule and scope in the written contract. Contract pricing is fixed for the agreed term. Either party may terminate an ongoing contract with 30 days written notice. Early termination may be subject to a pro-rated settlement for work already completed.

Force Majeure

D&D Commercial Services shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including severe weather, equipment failures, government orders, or supply chain disruptions. We will notify you promptly and work to minimize any service interruption.

Intellectual Property

All content on this website including text, images, logos, and design is the property of D&D Commercial Services and protected by applicable copyright laws. You may not reproduce or distribute content without prior written permission.

Privacy

Your use of our website is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using our website or services, you accept our Privacy Policy.

Amendments

We may update these terms at any time. The "Last Updated" date at the top reflects the most recent revision. Continued use of our website or services constitutes acceptance of the updated terms. Material changes will be noted on our homepage for 30 days.
